Newham man’s sentence upheld for hiding drugs in Kinder egg

A Newham drug dealer who insisted he had nothing to do with heroin and crack cocaine packed inside a child’s Kinder egg has had his complaints thrown out by top judges on appeal.

Alex Bennett, 48, of Central Park was convicted of possessing Class A drugs with intent to supply at Inner London Crown Court in March and sentenced to seven years in prison.

Police chased Bennett from a known Plaistow drug den and saw him throw away the yellow egg, usually found with a toy inside a chocolate Kinder Surprise, last year.

Judges threw out his claims that he did not receive a fair trial at London’s Court of Appeal.

He added: “Two officers gave evidence that they saw the appellant discard a small yellow egg during the chase.”

Bennett admitted having cannabis but insisted he had nothing to do with the egg.

On appeal, his legal team argued the trial judge was wrong to allow the jury to hear details of Bennett’s two previous convictions for possession with intent to supply Class A drugs, in 2003 and 2007.

Mr Justice Ramsey concluded: “The judge was quite entitled to admit evidence of bad character....we do not consider there are any available grounds of appeal.”
